Hello,
My name is Ashutosh Rai, and my mother Kamlesh Rai was a constable in UP police. She passed away in feb 2018 but i am unable to withdraw her GPF as the nominee is my mother's first husband who she left a long ago but not legally (i am son of her partner with whom she was living for more than 20 years). I have no idea where her first husband is, i am on verge of poverty, force to leave my education and very depressed, no one is helping me from police department and lawyers i consulted only took money and did nothing. Please help me with this i will be grateful.

A.Hai,
Since your mother has not legally divorced her first husband, the pension fund will be entitled to him as he is the nominee. However you will be entitled to the funds only if he waives off the funds. If you find this helpful, please rate us.

A.Hai,
If the nominee is married with a joint-life payout option, the default beneficiary is automatically the member's spouse unless the spouse waives that option. The spouse would need to certify in writing via a spousal consent or spousal waiver form that they are choosing not to receive survivor benefits. It may need to be notarized. If done properly, this allows the member to designate another beneficiary, such as a child. If you find this helpful, please rate us.

A.Nominee is not complete owner of the property. U as a legal heir can have ur right by way of obtaining n producing Legal heirship certificate
