We are doing part payment on under construction property in Pune since 2018 till date, but in 2020 the project is registered in Rera and commencement Certificate is issued for the same and till date the project is under construction, But now when we want to do registration and stamp duty the builder is asking 12% get on Basic cost + Stamp duty and do not want to mention the same in sale deed also, he says we have opt for old gst regime so we are charging 12% gst. Please guide what is the exact rule and the Basic cost is 21 lacs

A.The same is not payable by you.
serve a legal notice and thereafter, if this does not get settled since this is not forming a part of the agreement entered into, then you may move before RERA as per the relevant jurisdiction.

A.Hi,
File a complaint with the Real Estate Regulatory Authority for delay in delivering possession, this amount will be mentioned in the sale agreement and is often a significant penalty which the builders have to compensate you with. Serve them with legal notice asking them to mention the stamp duty in the sale agreement.

A.Hi,
Serve them with legal notice stating that these costs were not included in the original sale deed.
You can also claim damages for delay in delivery according to the terms of your agreement. The Real Estate Regulatory Authority should be notified of the same and a complaint must be filed against the builders. If you wish yo initiate civil money recovery proceedings, we can assist you through the process.
