I have given a cheque of 2 lakh to a real estate firm for booking of a plot.later I decided not to take the plot and I informed the same to that real estate firm.they accepted it and I cancelled the cheque..but real estate not giving my cheque back even after 90 days (I have written date on cheque)..if they deposited cheque ..cheque bounce happens or not..will it comes under 138 negotiable act

A.Hi,
Since it has crossed 90 days, the validity has lapsed. It is advised to you to provide a written letter to the real estate stating that you do not wish to continue and you are cancelling your cheque for proof.

A.Hi,
It is advised to you to provide a written letter to the real estate stating that you do not wish to continue and you are cancelling your cheque.
If any such matter arises in the court you can use it as a proof.

A.No. As 90 days have crossed so if they deposited cheque and..cheque bounce happens it will not come under 138 negotiable act.
