New Employment Agreement

I am working as a software professional in a startup. According to my current agreement, notice period is 60 days and in case I leave without serving notice period, I am liable to pay 60 days salary.
My employer wants to sign new employment agreement. According to this, I have to pay one year compensation, if I breach notice period clause.
I have option to sign or resign.
What should I do? Is it legally valid to ask for one year compensation for notice period breach?
