I had bid for a tender with 120 days limit. I was lowest bidder.I was negotiation took place after 120 days. As it was first work,so I negotiated. In between that period the rates of few items had gone sky high.After that its been 5 months I havent started the work as the site is not available.Can I withdraw and get my earnest money back?
A.I can arrange settlement with department itself.

A.whose fault that site is not available? ( website?). And what correspondence you have done in the meantime? Which department? Did the department send you any communication ? what is contract amount ?

A.if the rate has gone sky high within the period defaulted by them then you can apply to the concerned authority telling them about the case and seek your relief from them, if they do not agree then you can file a case before the high court to take your relief.
