I had a personal loan from a private company called Stashfin. When I took the loan in 2018, 2 accounts reflected in my CIBIL report: One is Akara Capital (Stashfin) and another is DMI Finance (they said it is the lending partner of stashfin). Anyway fast forward 2years, I could not pay EMIs for a few months during covid time. However, later I have foreclosed the loan as per their conditions and received foreclosure letter as well from Stashfin. Despite foreclosure, my CIBIL is still showing "written off" status in the DMI Finance account, although the other Akara Capital account status is showing as closed. I have raised the dispute from CIBIL several times but of no use. Everytime it comes back as 'No Change". I tried to follow up with the lender Stashfin several time to get rid of that written off account from my report, but I never get any response from the company. I want to file a legal case against the lender, firstly for opening two accounts in CIBIL against one loan and then not closing both the accounts with "closed" status despite foreclosure. One of the accounts is still reflecting written off. Please let me know how to initiate legal action agains the lender

A.Send legal notice with help of Lawyer
then you can file a civil suit for fraud and misrepresentation of facts.
You can also file FIR for fraud under Section 415 of IPC.
You can also file consumer court case for compensation.

A.File your case under MRTP and also under competition law.

A.Hey,
You can send lender a legal notice with help of advocate for closure of both the account and then if they don't respond to that you can file a civil suit for fraud and misrepresentation of facts. You can also file FIR for fraud under Section 415 of IPC.

A.Hey,
First step would be draft a legal notice against lender and if they don't reply to that or your problem is not solved then you can file a civil suit in the court for fraud and misrepresentation of facts. A FIR for fraud could also lodged under Section 415 of the IPC.

A.See you can file a legal case against them and go ahead but that will take lot of time to get settled instead what you can do is you can try ODR- Online Dispute Settlement through Vidhi Samadhaan
