I was working with a firm for their out of India project. In the appointment letter they have mentioned to pay certain amount as training cost if I leave the job before 2 year. But after my deputation outside India they made such circumstances I had to serve notice period which the company accepted as resignation. Now they are asking the training cost which they have mentioned in appointment letter but training was not provided to me. The company is based in Mumbai, my family is in Delhi and I am out of country. Please advise.

A.what are such circumstances.
you shud not lie to lawyers.
You are leaving job to get permanent job out of india.
so company will definitely feel cheated and they will file case to recover the money in Mumbai.

A.Hi,
The Industrial Disputes Act prohibits poor working conditions. In India and abroad, it is unlawful to force an employee to quit a job due to an excessive workload, harassment, or poor working conditions. Furthermore, if the organization did not provide you with any training, they cannot claim payment. You can take the company to court if they continue to make unfair requests and threaten you by giving you a legal notice or deducting your pay.

A.Hi,
You need not pay such amount to the company, as the training was not provided. Such demands are illegal. If they initiate a legal case against you, you can easily contest. If they deduct the amount from your salary receivable, can also approach the court to recover the same.

A.Dear Sir
You are not supposed to pay such amount and ask them to recover to civil court if deducted from your salary then approach court to recover the same.

A.Either you can reply to that notice through a lawyer accepting and rejecting whatever is mentioned in the notice and pay or not pay as you would wish or if you wan to settle the matter through ODR- Online Dispute Resolution process through Vidhi Samaadhaan on VCDR then you can initiate the process here and Vidhikarya team will approach the form as per the VCDR process to settle the dispute.
