I was offered by a school to join in january. I received offer letter on email about the joining date and my designation as HR. I accepted and joined. In the month of march, there was lockdown, i started wfh . No new joinees was given appoinmnt from january. In the month of april, i mailed my managemnt from my personal id to provide me feedback of my work . Both the directors replied that they were happy associated with me.
In the month of may, i had a meeting with two admin members regarding some task assigned to me. I told them, as i have been loaded with so much tasks, i would require time to do it and everyday i work till 2am because of extreme pressure. Next day two directors had a zoom meeting with me. Their approach that day was too different. They asked me to show the work that i was doing. They were not haapy suddenly with any of the works. In the evening female director called me that i shouldn't have discussed about my work load with other admin and should only discuss with her as that person has complained making his own story to the other director and this is going to be a problem..
Next day i started doing usual tssks but suddenly they blocked my ids. I received a call from the Hr who i was supposed to replaced( they hired me because that hr was very rude to all and they have warned her multiple times and also once removed her , as they told me). She tol me that she is feeling bad to say that i am no longer working with the school and the managemnt asked hwr to block the id. I asked her what is the reason . She said she is not aware . I told her to ask and let me know. She then agqin called me and told me director is not happy with my performance. I told her 30 days back they were happy and now not happy. Where is my non performace letter, etc, i asked her and warning letr, she hd no ans. I told her since you are removing me from the system, i need the current months salary and salary in lieu of notice period. She told me it all will be given. Same day a person came to my place and took the laptop and phone provided to me. I wrote them a mail two days after that as asked by the hr i had handed over the school property and to clear my dues which i mentioned including travel conveyance etc. Seeing the mail she called me as directed by managemt that if i resign backdated i will be given all the dues. I told her clearly that if dhe gives me in writing that all my dues will be clared and then i will giv redignation bck dated or gv my termination lettr. She denied. After two 2/3days she called tht current month salry wil be givn but not any amount. Moreover, after another 2 days she called n said that i need yo complere all the tasks assigned before and they wil release notice period salary. I mailed to them tht as i nees to prepare hr handbook and other hr related stugg i need dystem n resources. I will do. She then cald me tht it wil nt be givn n i shoud do in white paper... A.You certainly cannot got to the labour court as do not come in that category. What you can do is send a legal notice to the institute to recover your dues and later file a case in a civil court on that basis. Keep the records of all the communications exchanges that will help you in building and proving the case.

A.Hi,
Send legal notice first for recovery of dues. Whether you can file a case in the labor court or not will depend on the nature of your employment with the school. Please consult with an advocate for further advice with the employment contract and other related documents.

A.Hi,
You need to first send them a legal notice to recover the dues and for reinstatement Whether you fall under the ambit of Industrial Dispute or not will be subjective and would depend on your contracts terms and the nature of your work. If you fall within the ambit of industrial disputes Act, then only you can approach the labor court, otherwise you will have to approach a civil court for the relief.
