I have resigned on Jan 2021 due to work load and health issues. As per company norms there is 3 moths notice period. I have asked my MD to accept my resignation but they have asked me to continue with company but I have asked many times to accept my resignation. In May 2021 company offered hike and said there is no work load. But I did not accepted offer. Still I did not get acceptance letter. If I have asked now they are forcing send resignation mail now and serve another 3 months notice period. Can you please advice me.

A.Dear Sir,
If you do not require any experience certificate then you may resign immediately and join new company. In most cases corporates never approach the Civil Courts to recover a small amount of three months notice period.

A.Its your choice as its your job and career and you will have to decide basis your future and ambition that what you want to do and how you want to do and achieve. Legally there is no point in either accepting or rejecting as you will have to follow the employment contract that's it.

A.Hi,
As per the timeline, you have already served the notice period. A person is deemed to be an employee of the company till such time the employer formally relieves him from service. Unless stipulated in your offer letter or employment letter there is no requirement as such of an additional notice period.

A.Hi,
After receipt of the resignation letter, an employer cannot terminate the employment of the employee. The employer is bound to relieve the employee from the services of employment on the basis of a resignation letter and not otherwise. You can complain with the State employment dispute forum.
