My sister is living in Bihar with her husband's sister's family,
Her husband's bahnoi keeps torturing her mentally and threatening to beat her,
When my parents went to them to talk about it then he abused them badly and tried to beat my 70 years old father, he has threatened to beat my father and my sister.
I live in Noida, please suggest me some legal solutions by which security of my sister can be assured.
And something which I can do from Delhi or Noida only.

A.Dear Sir,
You can file case in Noida by bringing your sister by approaching local police there. Your sister is entitled for monthly maintenance and also can register Domestic Violence case against her husband and his family members.

A.Your sister's husband's bahnoi is doing domestic violence as well as crime under Section 498A of the Indian Penal Code so it is necessary on the part of your sister to lodge FIR in the local Police Station,however, if it is not possible for her, then it is necessary on your part to lodge zero FIR in this regard as the victim's brother,before your local police Station at Noida. That Zero FIR after being registered will then be transferred to the police station that has the actual jurisdiction to investigate that cognizable offense.

Please take note that a zero FIR can be filed in any police station within the territory of India by the victim( irrespective of her residence or the place of occurrence of crime) or by her family or a relative, or any other person who knows the facts relating to the incident and the police officer cannot refuse to register that FIR even if the commission of the offense was outside that police station's jurisdiction because justice is neither delayed nor denied.

Please further take note no Police Officer can deny the registration of Zero FIR. It is lodged under the serial number “0” and hence, its name.If the officer-in-charge of your local police station refuses to record the information, then you can make complaint to the Superintendent of Police (SP) who can either direct the lodging of the FIR or register it himself and initiate the investigations.

Firstly try to release her from that surrounding and take her to some safe place. As early as possible initiate a domestic violence complaint and approach the women's protection cell. Alongside your father can also file a complaint in the police station for threatening and physical violence.

A.You can ask your sister to file an FIR to the police of 498A or of domestic violence. If she is not able to do that there in that case try to get her out of that place somehow then then file the complain in your parent's place police station and initiate the case against them.
You have to ensure that your sister is out of that place to first bring her out of any danger of getting assaulted further physically harmed then thin of any legal action.
If things turn out very ugly then go for ZERO FIR, which can be filed in any police station even in NOIDA or Delhi.
