You may immediately file domestic violence case or civil case. Further file interim applications to restrain your husband from moving outside the India saying that if he moves to Abroad you will on streets.

A.Hi,
Petition for Restitution of Conjugal Rights can be filed by the affected person who want to restitute his marriage life. This Petition can be filed when one of the spouse desert the other and stay in another house willfully or due to the coercion by another person. You can simply approach the court and file it u/S 9 of HMA.

A.Hi,
A decree of restitution of conjugal rights implies that the guilty party is ordered to live with the aggrieved party. Restitution of conjugal rights is the only remedy that could be used by the deserted spouse against the other. Since you are the aggrieved party, you may file an RCR petition in the district court and send a copy of the petition to the respondent with a hearing date from the district court.

A.File a case under Section 9 of Hindu Marriage Act for Restitution of Conjugal Rights and move an application for urgent hearing citing the reason that he is moving out of the country. Speak to your lawyer and see the possibility of filing a temporary injunction on his travel unless he is taking you with himself or the Section 9 case is resolved.
