1) Can the secretary of a housing society be developer of the redevelopment process?

2) in case there is only one opposing member to redevelopment due to monopoly of the secretary who wants to redevelop the building, what happens to that members rights?

A.Hello
There is no law which prohibits the secretary of the society to be the developer in the redevelopment of the said society. If you have any objection to the same then you'll have to find more people like you who also object the same and raise the issue in the society and could give the redevelopment project to someone else, but for that you would be requiring consent of more than half of the society members.

If all the society member oppose together on secretary being the developer of the said society in that case only the secretary of society cannot be the the developer in the redevelopment project.

A.Dear Sir,
Normally, he should not be a Secretary of the housing society. Please consult local lawyer for getting clear legal advise on local laws and local practices. In many States local practices are different and not in accordance with law and rules which public has to admit.
