Hello sir/maam ,I've given a contract to a builder for the construction of my house nd the construction quality is so poor that the floor got cracked nd tiles are simply hanging on the wall. The builder was my relative's friend so the payment was all made in cash of Rs.20 lakhs. Every month I have to face a new problem nd had to get it repaired, I've spent 5-6 lakhs on repairs nd the problem doesn't seems to stop.
So my question is can I file a case against him though I don't have any legal proof of payment made to him of 20 lakhs because it was made in cash.

A.Dear Sir,
You may get issue a legal notice and threaten to approach Consumer Forum or Civil Court claiming huge compensation. The builder may come down for settlement since he may not get new contracts for constructions.

A.This is deficiency as well as negligence in service on the part of that Builder so after giving legal notice it is necessary on your part to lodge complaint before the District Consumer Disputes Redressal Forum. Absence of documentary proof of such cash payment will create problem to support your claim for monetary compensation so it is necessary through proper correspondence letters to get some sort of admission from the builder in this regard.

A.Dear Sir/ Madam,
Approach the builder and let him know and then you can issue a legal notice. If he still refuses to comply with the notice then you can file a case.

A.Dear Sir/ Madam,
Yes, you can issue a legal notice for starters and then if he still refuses to acknowledge your issues then you can file a case against him.
