sir iam facing harassment from my husband and his mother from 2 years .I want to file a case against them .how to file case 1.can file case in local police station or 2. through court.(in my mother place/husband place) 3.please give clarification on child custody(can i take child custody during divorce or after diverce)

A.You can firstly complain in the women cell and next you can bring upon a suit of domestic violence against your Husband and inlaws. Custody of the child below 12 years is often given to mother if she has enough means to bring up the child.

A.You can lodge a complaint under section 498A IPC before the police station having jurisdiction of your area. And you can also approach court U/S 12 OF DV Act.
File for maintenance immediately. If a child is minor his custody lies with the mother itself.

A.Lodge a complaint in the local police station under Protection of Women from Domestic Violence and Section 498A against your husband and his mother. Once police/protection officer interferes they will get frightened. Actually you're responsible of your situation. How could you kept silence for 2 long years?
File a petition for divorce and maintenance and also custody of your child. You will get the custody of the child if your child is below 5 years. Both you and your child are entitled to get maintenance. Please contact Vidhikarya for the allotment of a lawyer for filing divorce etc.

A.You may file a complaint case against your husband at your mother's place. you can also file a case for maintenance for yourself and your child. Question of custody of child will only arise when the child is more than six year old and in that case you will have to file a petition for custody of child before the family court.

A.You can easily file a case before the women commission. And with respect to child custody you have approach the family court.
