Hi Sir/Madam,

I'm planning to buy 5000sqft property in Village( Gramatana property, E-swathu doc is there) which is actually in the name of 3 persons A,B & C.
all A,B & C are almost near 80 Year old, has children and grand children as well( total around 20 -25 persons in this family chain) , during registration if any one is missed to sign on the sale agreement/Consent. Can I still go ahead and buy by taking signature of few who would be ready to sign. later if any successor go to court for their share of property Will I lose all 5000sqft or only some portion of land ??

I dont want to give up buying this land..

Please suggest. Thanks in advance.

A.Dear Client
You need to figure out that who is current owner of the property as per the land records and basis that you can get the signature of those persons on the sale deed to ensure proper transfer of the land. Get in touch with some local lawyer who can assist you in this matter.

A.Dear Client,

Since it is a hereditary property, each family member inherits a right to it. In this case, all family members must sign the Sale Deed because they must all agree to relinquish their rights to the hereditary property.
The sale deed must be signed by all persons with an interest in the property and in whose name the property is registered. If an unusual situation occurs in which someone can claim an interest in land, even if not immediately and apparently, it is preferable to obtain the signature of such person to show his consent.

A.It is advisable to take registered Power of Attorney from them, so that such power of attorney holder can represent all of them before the Registering authority and all other Government and non- Government Authorities for signing all documents on their behalves regarding that property purchase and thereafter apply for property mutation.
