Can i file complaint against the builder.

i have purchased 1bhk flat in panvel, stamp duty registration is done. and possesion of flat is dec-2020 as per RERA. but he told me i give in dec 2018. and i gave him 10% 1.5lac amount. and home loan is 26.50lac. In agreement total value is 28 lac. now he said our deal is 28.5 lac and also in agreement the 10% amount at the time of possession. but he got all amount from bank. Bank employee also his faver. At the time of sign check bank employee say i release 80% amount but after that he told me builder required 100%amount. So on this basis can i file compliant against builder.

A.raise a complaint with RERA under section 61 of the Act that the promoter is involved in unfair and fraudulent practice. Further had violated the terms and conditions laid down under the Act.

First You can send the legal notice and lodge compliant to RERA authorities and it will be solved in favour of you.

A.For any amount to get released from the bank to the builder, usually, any bank requires a letter or request note from you to make the disbursement. From what you say, the bank has released amount from your loan account without your consent. So, you have a good case against the bank.

A.First you can issue a legal notice to the builder.

A.Hallo sir, Complaints can be filed under Section 31 of the Real Estate (Regulation and Development) Act, 2016, either with the Real Estate Regulatory Authority or the adjudicating officer. Such complaints may be against promoters, allottees and/or real estate agents. Most state government rules, made appurtenant to the RERA, have laid out the procedure and form, in which such applications can be made. For filing complaint kindly approach and contact with vidhikarya lawyers.
