Hi,
I am purchasing agri land in karnataka, however i dont own any agri land as per norm. My father holds agri land in AndhraPradesh and has a passbook against the same. may i get a notary against the passbook to get into lineage to purchase the land in karnataka

A.If you want to purchase some other agricultural lands I can arrange so that you legally purchase it.

A.You might lose your money and that land altogether if you follow the procedure suggested by some ignorant person. Karnataka Land reforms Act is not that simple. Nowadays whatever records you bring from other states are not believed, will be counter checked and some times by error will eb totally disbelieved.

A.As per Karnataka Land Reforms (Amendment) Bill, 2015, a non-agricultural persons can purchase farmland who's annual income is less than INR 25 lakhs and comply with the other formalities as envisaged in law for the purpose. I would suggest you purchase the farmland in your father's name as he already have APFC and his annual income is less than INR 25 Lakhs. Contact a local lawyer from Vidhikarya.

your father will have to make application to assistant commissioner for permission for such purchase. Asst. commissioner may grant permission subject to condition that your father takes up agriculture within period of 1 year. If your father cease doing agricultural activities within period of 5 years, the land may vest in State govt on payment of compensation.

A.A definite answer would be “NO”. The rules for buying agricultural land in karnataka is very stringent. The family tree should be produced while purchasing agricultural land and, you will have to produce adequate proof that your ancestors had agricultural land or hail from the farming community. Don’t fall for any touts claiming that they will arrange all papers by bribing officials. Because The Karnataka Land Reforms Act now does not allow non-agriculturists whose income is more than Rs 2 lakh per annum to buy farm land. Any person who does not own agricultural land in Karnataka is a non-agriculturist. Kindly contact with local property lawyers or vidhikarya lawyers for getting all land purchasing procedure.

So if i got my family tree done and produce the same along with the passbook of the land holding my fathers name pertaining to the agri land, i should be able to purchase without any issues??

A.Dear Sir,
You can purchase land in Karnataka if following three conditions are satisfied irrespective of your father holding land in Andhra Pradesh and holding land in Andhra Pradesh will also be considered as Agricultural Family. That land must be in the name of your father or your ancestors as on 01.03.1974.

Agricultural land can be bought in Karnataka after fulfilling certain requirements.

These include:

The annual average income of the person including agricultural income should be less than Rs 25 lakhs.

The person must have had an agricultural land in his name before the year 1974. The person should be an agriculturist or an agricultural worker by profession.


As per Section 79A of the Karnataka Land Reforms Act 1961, the non-agricultural income of a purchaser who must be an agriculturist should not exceed Rs 25 lakhs per year. Sale of land granted to members of scheduled caste and tribe is not allowed. Also, sale of land granted by the government is not allowed for a period of 15 years. Agricultural land can be used only for agricultural purposes and no other purposes. Utilising agricultural land for any other purpose is prohibited by law. Agricultural land, which does not come under the Green Belt, can be converted for non-agricultural purposes like residential, commercial, industrial etc, subject to the approval of the Special Deputy Commissioner on payment of the prescribed fees and subject to certain conditions.
Dear Sir,

You must satisfy the following conditions, if not then you must get a certificate showing you are agricultural labor. The later is easy because even Amithab Bachan taken such certificate to legalize his purchase of agricultural fields that is coffee estates.

(i) That he is coming from agricultural family and holding agricultural lands as on prescribed date i.e., 01.03.1974.

(ii) That his individual income is less than Rs. 2,00,000/- per annum and

(iii) That he is having source of income to purchase above agricultural land.
