Respected Sir/Madam,




The Institute of Chartered Accountants of India (ICAI) is a statutory autonomous body established under an Act of Parliament (Chartered Accountants Act 1949) which regulates the profession of Chartered Accountants as well as conducts CA course and issue membership to the qualified students. Headquartered at Indraprastha Marg, New Delhi, ICAI is a part of the state which has to maintain high principles in its affairs and administration. ICAI is having 5 Regional offices and about 165 Branches across India.



There are many employees working in various branches of ICAI on a permanent basis for a long time (1 to 30 years experienced employees are included in this group). After repeated requests and efforts from the side of employees, ICAI introduced a scheme to regularise Branch employees once in 2006 and a revised scheme in 2014.



Under the 2006 scheme about 120 employees were regularized. The scheme was having many shortfalls in terms of payment structure, labor rule compliances etc. PF envisaged under the said scheme was not properly managed. PF accounts never opened, PF amounts deducted from employees have been deposited in bank account in Delhi. (ICAI is having PF Trust registered under Income Tax Act not registered in EPFO) Salary and other emoluments given under the scheme were pathetic when compared to any prevailing standard. Many employees under the scheme have retired and around only 60 Employees are remained many are on the verge of retirement without getting justice to their services and commitment. We do not know our PF Balance, we do not know if they are depositing thier share.



Under the revised scheme proposed in 2014 interviews of branch employees completed at all India level but appointment letters were not issued till date. Branch employees under the banner of the welfare association visited Delhi two times in 2014 and 2016 and submitted representation to higher authorities of ICAI directly. But till time our issue is pending unresolved.



Our appointment in 2006 Scheme was given by Branch Chairman with overall directions and scheme laid by the Head Office. Our salary is paid by cheque and PF deducted are sent to Head Office through Cheque then Head Office Remit Branch our Salary as well as PF.


ICAI wants us to give fresh appointments (Which will cut our experience) so that they can escape penalties/Interests of the violations it is doing. So in 2019 ICAI initiated a process to register PF Trust with the Income tax Department for branch employees region wise. Delhi, Mumbai, Kolkata, Chennai and Kanpur respectively. This process is still not completed due to some technical issue.
