We have signed the mutual petition but not presented it in front of a judge papers are signed mutually by both in front of a lawyer; now a girl can file 498(A) cases against family members?

A.Hello Sir,

As per the facts which had been provided, the girl can file for Sec 498(A) IPC against family members as the judgement has not been passes in this case till now.

A.A girl has the right to file a complaint against her husband and/or in laws any time from any place only. Since the mutual divorce petition has not been filed yet therefore it shall have no such importance as it is not registered before any court of law. Either of the spouses may change their decision until passing the final decree and judgement of mutual consent divorce and in your case, the said petition has not been yet filed also. You should consult with a good family disputes lawyer who deals with family matters regular;ly and thereby also file a contested divorce against your wife immediately. There are some more measures which you must take to get relief from your troubles at earliest which can be discussed only during consultation and not in any public domain.
