Hello sir.. My brother is working in Sbi for last four yrs. Recently he died with severe infection after having two surgeries for gallbladder. Now he left a house which is in house loan with his wife as nominee. My parents are totally depending on my brother. Now do my parents have any rights on any of the things coming from my brother like of or pension.. Can they claim or go to court for anything.

A.Your parents have a right to live in the house. If she is creating any disturbances, your parents can lodge a complaint with the local police station under domestic violence. As for right to succession, as per HSA only the Class 1 legal heir qualifies to inherit the property of the male hindu. The widow wife and your mother shall have equal rights and liabilities over the immovable property. For pension, pf and gratuity, the widow wife is entitled to get full benefits under the law. If there's an insurance, both your mother and widow wife will get equal share of the insurance benefits. Call me through Vidhikarya for consultation

A.Yes , your parents also have rights over everything he left behind. and clearing the laon of the house being a separate matter, just being a nominee does nt make her owner of the house. She may be applying for his job on compassionate grounds if she is not already well employed.

Yes, not necessary to be senior citizens. Let them make their claims before the Bank gives the funds to nominee. Make a written claim and obtain reciept.

A.If your brither had made his wife as his nominee there is no claim,provided your parents are senior Citizen covered under the Act, they can share the benefits without any reservation from your brother"s wife.
