Query regarding onetime deposit charges

Does a builder need to pay a onetime deposit toward clubhouse and pool if he is leasing out his unsold apartments to families for 11months and the tenants are utilizing the club n pool facilities? All flat owners have paid a heavy deposit at the time of purchase towards clubhouse n swimming pool charges which as per agreement will be refunded once a society or an entity is formed.

No amounts will be refunded and they may be adjusted towards some other corpus fund. The so called builders collecting one time deposits and swallowing the same.
