My mama had agricultural land and he is unmarried. He has no other relative other than me, my brother and sister.
Around 25 years ago, I was seeking divorce from my first wife and in order to safegaurd the property that agricultural land was transferred to my brother through gift deed.
Everything sorted out smoothly.
Based on the trust we managed to take care of the agricultural land without further having division into it.
But now when I am approaching to have the land divided and transfer the applicable share, he and his family are repetitively avoiding me. They are not willing to transfer half of the share and in greed as gift deed in my bothers name.
Can this be challenged considering the conditions under this gift deed was made ?
Because anyways this property belonged to my Mama before doing a gift deed in my brother's name.
Kindly suggest.

A.Dear Client,

You can go to the court and contest your brother's ownership over the property. If there was any witness who can claim that the property was supposed to be divided between you all equally then you can get their statement in the court as well.
