Evidence affidavit - difference in affidavits
1 year ago
I want to know is there any difference in affidavits in normal proceeding petitioner evidence where respondent present and exparte evidence ..both affidavits are drafted differently in dv case
A.Dear Client,
there is a difference in both the evidence affidavits. when it is not an ex parte, then the affidavit must contain the allegations in the petitions, contentions and the counter allegations or explanations should be present. if it is exparte, then the facts and other things mentioned in the affidavit.

A.Dear Sir,
Yes, if it is ex-parte the Affidavit contains only the averments made in the petition. If such DV case is contested by other side then the Affidavit must not only contain the averments made in the petition but also there must be denials to the contentions taken by other side and explanations to be given to the allegations made by other side in their objections.
