Defamation regarding

Within 2 months of my mother’s demise, my sister in-law has kept a “dp” in my mom’s Mobile number. That “dp” and “status” are about her religion!!!! My in-law belongs to a different religion.
She is using my mom’s mobile phone!!!! My brother has given my mom’s phone to her!!!
People who are unaware of my mom’s death are calling me and asking whether my mom had converted into my in-law’s religion!!!!! My in-law has completely ruined my mom’s identity, dignity, name and fame. She has misused her mobile number for spreading her religion!!! Is it a criminal offence??? Can the judiciary system of India help me???

You may get issue a strong legal notice intimating to initiate civil and criminal defamation case as it is a family matter and hurting sentiments of your family members. It also attracts IPC sections for which she is liable to answer and you can file a complaint with Cyber Police.

A.Dear client, I am sorry to hear that but this is not a crime. Spreading of religion is not a crime in India as per the constitution. Hence she cannot be booked.
