We r 3 brothers including me.
I m the eldest.
Born & brought up in an ancestral house at BDD (Bombay Development Directorate) Chawls in Worli,Mumbai.
Presently, myself & youngest brother staying seperately.
2nd brother staying with mom,his son, daughter & daughter in law.
With mutual understanding & monetary consideration a verbal deal of equal share was finalized.
Now he backed out from his commitment to pay us.
Got to know from PWD (Public Works Department) office that with mom's consent he transferred the house in his name.
My query.
As per ancestral law,can he transfer the house by mom's consent as it's an ancestral house from father's generation.
As understood that in ancestral law Mom is a custodian for the legal heirs.May be by bribing the authorities, illegal act have been done.
Request advise for further course of action,cost incurred & duration pls.
