After planning for divorce, My husband has transfer his home to his mother without completion his home loan .is it legal ? And still he took responsibilities to pay home loan. Legally is it possible? If no than what action bank can taken against him? Can I count home as my husband property ,& demand maintanence ?

A.Dear client! If your husband has transferred his flat to his mother with the possibility of getting a divorce case. it will deemed as done with malafide then the gift deed, done by your husband to his mother, will be easily revoke through the court.

Home Transfer is done in Nov-16 .is it possible to revoke after this much time ? While according to my knowledge my husband loan is pending till March -2018.at present home loan status is not known.

A.By advocate Rameshwor dadhe dear sir yes you can claim on your share. Because Ur husband perches it then transfer.

Now mother in low says flat in which we were living is her property . More over she took in written from my husband that there is no right of my husband because home is given by my husbund's mama. Mean it's ladies property .

It will be possible but which procedure they are follow I don't know . But it is legal.
A.Why not initially hone was purchased by your husband therefore you have your share in it being legally wedded wife subsequent transfer of property will not affect your right.
