Worked in a small size IT company from 1 June 2022 to 19 July 2022. Got terminated because client didn’t sign up for the project. Received salary from June 1st to June 25th (25th - 25th is billing cycle). Salary from 26 June 2022 to July 19th is pending. Company not ready to release relieving letter or salary balance. Is it possible to proceed leagaly to get salary balance. If so what are the basic requirements to meet and the procedures.

A.Dear client, in my humble suggestion, if the employer doesn’t pay up your pending salary, you can approach the labour commissioner. They will help you to reconcile this matter and if no solution is reached labour commissioner will hand over this matter to the court whereby a case against your employer may be pursued. Alternatively, you can also file a suit under Section 33(c) of the Industrial Dispute Act, 1947 for recovery of money due from an employer.

As far as the relieving letter is concerned, you can negotiate with the employer as there is no legal remedy for the same.
