This dispute is regarding the monthly expenses which my father used to pay to our family, All of a sudden he stopped giving monthly expenses to my mother.

He is a government retired employee and he receives monthly income on the fixed deposit that he made post-retirement.
Now we wanted him legally he should pay monthly maintenance to my mother who is a housewife and has no source of income.

Further, he has two houses and a large sum of money which he made clear that he will not share with his family and keep with him for the rest of his life, so we wanted to know can my mother legally claim some percentage of his wealth.

Kindly please advise on both the monthly maintenance disputes and legal share in his wealth.

A.Dear Client,

Your mother can file for maintenance under section 125 of CrPC. Please consult your lawyer near you to understand better how to proceed in this situation. In regards to the property, you are eligible to a share only in the Ancestral property, in regards to your father's self acquired property he has the choice to remove you as the legal heir if he wishes, unless you can prove you contributed towards the acquisition of the property.
