Amount deducted for Gratuity

In my previous employment with Max Life Insurance Co. Ltd. gratuity amount that is 4.81% of my Basic deducted from my CTC. Since I have left the company in 3 years and 6 months so definitely I am not eligible for gratuity but they are dening to pay my deducted amount too. So please guide am I eligible for my deducted amount without any interest or not, because in my previous to previous employment I had received it.

According to the Gratuity Act 1972, an employee is eligible to receive a gratuity amount after completing five years of continuous service at one organisation. The gratuity amount is paid to the employees once they retire, resign, or are laid off. Hence you are not eligible for gratuity.
