During covid times, if a family is unable to pay the school fee for one cycle, does the school have the right to stop the child from taking education? I know a family in Gurgaon. Father's job was discontinued due to covid and he could not pay the fee for one cycle. It was carried forward. He paid all fees after one cycle but now the school has asked the child not to come to school due to a one-time fee which was not given during the covid times. The child is in grade 6th.

A.Dear client,
The Supreme Court held that States cannot impinge on the autonomy of private unaided schools. School management can take legal action if students do not pay the fee installments on time. If it is a private school, then yes, they have all the rights to say so.
"It is open to the school management to initiate appropriate action for recovery of the outstanding dues," said SC.
But, as the father has already paid all the dues, the school should not be saying so. Please contact a lawyer and ask them to draft a legal notice against the school.

A.Every child has the right to get education hence no school authority has the right to stop the child from taking education. The parent of the child must send a legal notice to the school authority at first then they must file a writ petition against the said school authority before the Hon'ble High Court for proper justice and equity.

A.Dear Sir,
Now schools have become commercial establishments and private schools can claim such fees because they are rendering special services to the students. Any way you may approach Higher Officers in education department and get some special order in the given background.
