Agent is not giving back my passport.!

Sir. I applied for a job with some of my friends in UAE through an local agent. Then we got visa and all my friends went to UAE except me. I refused to go because some personal reasons. But now that agent is asking for money to return the passport. Please guide me. What should I do to get my passport back without so much of legal procedures!

A.Dear client kindly file police complaint for unlawful restraint of your passport . Send him legal notice through lawyer

A.Passport is the property of the Government of India. Passport should be in the custody either of the holder or of a person authorised by the holder. No one can with hold anyone's passport against his or her will until or unless it was asked to surrender by the Court’s order. Retention of Passport is illegal. Send them a legal notice ,followed by a Criminal Complaint with Police.

A.Dear Client,
Step 1.Request the Agent to Return Your Passport.
You should be prepared to pay back the money which the Agent has spent for obtaining your VISA.In case he has
spent. In these cases some are legal, the money paid to the Embassy or High Commission for which they give you
Money Receipt is the legal money. Any money other than this is illegal. Presumably he is asking that money.See
what is reasonable to get your Passport.
Step 2.Please see the date of Issue of Your Passport and also Date of Expiry.Normally Passport is valid for 10 years.See
how many years have passed and how many years left out.
Step 3. If he does not give/ return your Passport then inform to Police.Simply, the Agent can not keep your Passport.
Step 4. If your Passport is misutilised by the wrong people or wrong groups you might land up in more trouble.
Step 5. If he does want to give the Passport back to you after offering the legal money spent for your VISA then in that case mis utilisation of your Passport can not be ruled out.
Police might look for you someday with a Terrorist link .
Step 6. Lodge a FIR to the Police and retain a copy of FIR for future reference including submission of the same to the Regional Passport Office from where you have received your Passport.
