Respected sir, my father about 80 years, has worked in kptcl and got retired in 1999, he is having two wives, and bosrd refused tonominate both the wives for family pension, unfortunatley my father's first wife deceased last year, though also kptcl board not agree to nominate 2nd wife for family pension instead they deamnd for court order in this regard, can you please sujjest my mother( 2nd wife ) eligible for family pension, and my father didnt take any noc from kptcl board for 2nd marriage, but he was submitted both the wives photos and id proof at the time of retirement for nomination purpose

A.Dear client,
The second marriage of your father maybe void. I don't know if you are a Hindu or Muslim. But if you are a hindu, she is not entitled for pension because the second marriage is null and void when first wife was still alive and they were not divorced. If you are a muslim, then yes.. she can claim for the pension. The Court noted that Second wife (widow) can be granted family pension, in those cases, where more than one marriage is permissible under the applicable personal laws of the deceased employee and not otherwise.

Sir we are hindu my father is still alive, and not nominate any one fir family pension now 1st wufe deceased last year can he nominate his 2nd wife for pension, is there permision in kptcl board bangalore
