I have been married for 10 yrs with a 6 yr old daughter. Last 4 yrs I was in UK. We all are Indian citizens. My husband left home without a word and sent a separation notice through UK lawyer with eventual aim of divorce (usual physical and mental harassment). I returned back home with my daughter. Our mutual discussions with lawyers in India over expenses failed as his offer was peanuts.
I have been working and intend to in future. I was employed in UK as well for sometime.
1. What is my best recourse to receive a fair maintenance for myself and my daughter here in India?
2. How can I settle soonest with a lumpsum maintenance?
3. Will my savings and investments be counted in court? There is big disparity in income and expenses. His current income is at least 3.5-4 times of mine per month.

I have evidence of DV complaints against him.

You can find a proper divorce lawyer and charge against him and can apply for your maintenance and maintenance of your child as per your requirements.

A.First of all, if you are unemployed in India then you can claim for monthly maintenance for yourself otherwise you can only claim monthly maintenance for your minor daughter against your husband. Your investment and savings will be counted in the court only if you are getting any monetary benefit from such transaction. You may seek for mutual divorce from your husband along with a claim for certain amount of money for your daughter's good future.
