Hello Sir, There are two queries:

1) My father, alive ( God bless him long live.) and I jointly owned one house in Gujarat. My brother doesn't own any portion of house on any documents so far. But I found my brother took gas pipelined connection in this house on his name without informing any of us. is it legal ? if not, what kind of legal actions can be taken ?

2) for the same house ( jointly owned by me and my father), my father wants to evict him ( my brother) from his( my father) portion of share ( ie. 50%) thru will(Vasiyat). Currently, this house is occupied by my brother. in this case what is the way and what kind of actions can be taken against him to get house vacant.

A.Dear Sir,
Your father may get issue a legal notice and seek vacant possession of his house. Secondly, on the application filed by your father the pipeline connection may be changed in the name of father.

A.Dear Client
There are some cases under which another child can be evicted but there must be strict reason. legally your brother is entitled with 1/2 share of 50% that your father owns.

A.Dear Client
He can send the legal notice to vacate the place. Also, inheritance is not applied to the self acquired property. Therefore, your father can make the will to whomsoever favour he wants to make it. He can then send the legal notice to vacate the place. If then also, you can file a civil or criminal suit for illegal occupation.
