Scenario - Ive bought an mobile phone Worth 20K INR and later 1 and half year after warranty period Im getting a Software update to upgrade the mobile, Ive upgraded and later my mobile not functioning properly, Ive reached the Service centre and they are asking for 9k INR to fix the issue, Since its not my mistake why i should pay post which Ive reported a complaint in https://consumerhelpline.gov.in Website and also the Company reached me to handover the mobile to the same service centre to examine Later they agreed and confirmed this happened coz of the SW update and now they are asking me to pay 90% cost fix the issue, But Im not ready pay.
Question - In India is there any law to regulate these kind of scenarios, If a mobile or gadget is not working coz of the update provided by the company and after verifying they agreed that there is no physical or any other damage by me, mobile is not functioning properly coz of the SW, now who should fix it ? Can i file a case in Court ?

A.Dear Sir,
You may get issue a legal notice and then approach Consumer Forum to get refund of that amount along with Rs.2 Lakhs towards mental torture etc.

Thanks For your SWIFT Response Sir, So now i need to reach a legal adviser to send a legal notice to the relevant company.

A.You need to file a consumer complaint before the learned district consumer commission of your local jurisdiction against the concerned mobile company. As a remedy you may claim for a new mobile phone in exchange of the previous one which is in dispute and also you can claim compensation for such mental harassment and wastage of time.
