PF office issued withdrawal benefit under EPS despite my EPF membership of 19 years since they did not have past record of my service. Now, PF office is asking to pay huge interest amount for starting pension. Who can help me? Please guide. I am from Pune.

A.Dear Client
Have you withdrawn the PF balance from your EPF account? If yes then what was the reason for doing so? The EPF on its own cannot transfer the PF balance from the account.

Dear Sir, I had withdrawn EPF since I was not covered under EPF (due to higher basic salary) in next employments. I withdrew EPF with form 19 & asked for EPS scheme certificate with form 10C in year 2010. My continuous membership in EPF is from 1/Mar/1990 till 27/May/2009. EPF office gave me withdrawal benefit under EPS instead of scheme certificate for the period of 07/Feb/2001 to 27/May/2009 since they did not have my past service record for the period of 01/Mar/1990 to 04/Feb/2001. I had clearly opted for scheme certificate in form 10C. I had requested EPF office with written communications (& personal visits as well) that scheme certificate be given to me & informed willingness to remit money back to EPFO which was given to me as withdrawal benefit. Also, I submitted documents showing my past EPF membership from 01/Mar/1990 to 04/Feb/2001 but, they did not take any action to verify same & get records from respective PF offices. I personally ran here & there to two PF offices (Surat & Pune II) & got past service details officially communicated to RPFO Pune-I. This happened few months back only (Sep-2022). It took 12 years to get my past service records at last PF office i.e. Pune-I (that also done by me personally). Now, at 58 age, EPFO is asking for huge penal interest (for the period of 2010 to 2022) on withdrawal benefit for starting pension under EPS.

A.Dear Sir,
U may immediately approach Service Tribunal or PF Tribunal or High Court as the case may be so that u can get some relief.
