Property dispute - My father has invested a lot of money Property dispute - My father has invested a lot of money

My father has invested a lot of money if his ancestral farmland and paid for his parents expenses over past 30 years. After my grandfather passed away, my aunt is claiming an equal share in the property. As per my understanding, siblings are required to contribute to related obligations like land development costs and parent's maintenance expenses as well if they want a share in property. Is this a correct understanding of the Hindu Succession Act?

A.Under the Hindu Succession Act of 1956, the property of a Hindu male who dies intestate (without leaving a will) is distributed equally among his legal heirs. Legal heirs include his widow, children, and the children of any predeceased child.

In your case, if your grandfather died without leaving a will, his property would be distributed equally among his legal heirs, including your father and your aunt. Your understanding that siblings are required to contribute to related obligations like land development costs and parent's maintenance expenses if they want a share in property is not explicitly stated in the Hindu Succession Act. However, if your father has paid for the maintenance expenses and development costs of the land, he may be able to argue that he is entitled to a larger share of the property.

It's important to note that laws related to ancestral property and inheritance can be complex and vary based on the specific circumstances of each case. It may be a good idea to consult with a lawyer who specializes in property and inheritance law to get a better understanding of your specific situation.
