A friend of mine borrowed 3.25 lakhs in April 2022 by saying that he will return in 1 or 2 months but he has not returned it till now, it's almost a year. I have been repeatedly calling him, he does not pick up my call and sometimes sends messages and commits to some dates that he never adheres to. What can be my legal course of action?

A.Dear Sir,
U must have collected a cheque in support of your payment. Otherwise, approach Police, they may get cheque from that person.

A.Hello sir,
Send him a legal notice. File a complaint to the police. Send him letters of your own. Then file a money suit.
1.A lender can file a civil suit for recovering the money owed through promissory note or loan agreement. He can do so under Order 37 of CPC which allows the lender to file a summary suit. Drafting the summary lawsuit is the initial step in this process, after which the borrower should be served with the summons.
2.You can file a case under section 138 of negotiable instruments Act ,if the payment which is given by you is not in cash. You should file it within the limitation period. After the limitation period is expired it becomes difficult to file a case.
