I took a consumer durable loan for a laptop from Bajaj Finserve when I was employed financially sound for 10 month tenure. After 5 months I got laid off unexpectedly which effecting my financial planning and repayment of EMI's. I have conveyed the same to Bajaj through call, WhatsApp as well as mail to Bajaj. I was making delayed last 4 months but towards end of the EMI tenure i.e; March month onwards they were forcing me to arrange the payment somehow they don't want to hear excuses of financial hardships sent agents to home which I clearly objected not to. After clearing the payment last month, only1 EMI overdue in my tenure, payed 9/10 EMI, but I was not able to arrange it. I conveyed the same but they are forcing me, harrassing me in such a way and continuously pointing out of financial & personal hardship making me feel useless in such a way. I never failed to respond to them, but they always opt in for harrassing/mocking approach towards my hardships. Now they gave me an ultimatum to take my Laptop away if I don't make final EMI payment which is 6,250 INR. I don't know what to do. They intentionally come to home in 2 or 3 people to intimidate and harass in front of my family and neighbours.

In the given situation, filing a complaint against the recovery agents at the local Police Station endorsing a copy of said complaint to the concerned Lender, Bajaj Finance, a complaint against the loan recovery agents appointed by the Lender can be made to the regulatory authority RBI online at https://cms. rbi.org.in or by calling the helpline number 14440. The complaint may also be lodged by filing an offline complaint and submitting the same at the Centralised Receipt and Processing Centre (CRPC) at RBI, 4th Floor, Sector 17, Chandigarh, PIN-160017. In a recent judgment, the Hon'ble Patna High Court in the case of Dhananjay Seth v. Union of India, 2023 SCC OnLine Pat 1393, decided on 19-5-2023 directed the Superintendent of Police of all the districts in the State of Bihar, to ensure that within their jurisdiction no recovery agent of the Bank and Financial Institution might take the law into their hands without an order of the competent court of law. A.Dear Client,
As per the contractual obligation you are bound to repay the loan but the creditors have no right to harass you to recall the amount, there are rules set as per RBI guidelines as to how they must recall the amount. The creditors can no come to your private property at odd hours and must not use abusive language and if they do so there are certain legal remedies like filing injunction suit by sending a legal notice and also filing a case for defamation and trespass.
