We intend to substitute a property mortgaged with the Bank as collateral security with another property of approx. same value for which Bank has no objection, however the bank is asking to pay the full stamp duty of 0.30% on total loan under 6(2) of Maharashtra Stamp Duty Act.

We are of the opinion that we have to pay a flat Stamp duty of Rs. 500/- since there is no increase of loan amount and there is no change of primary security, even if there is an increase in loan amount than the stamp duty chargeable would be 0.30% to the extent of additional sanctioned/disbursed amount.
