Housing society election
Ours co-operative society is planning for election. However, there was no information given before calling for nomination that to within 20hrs. Next day election officer came n a voting list was displayed on notice board. Now existing committee members tried to retain there position and giving impression to others that we should form committee without election mutually. However, everything is kept secret even nomination list was not circulated stating it's to avoid confusion. After 9 days they declared nominations are closed thru WhatsApp. There is no intimation given on notice board for start n end date of nomination nor it was discussed on WhatsApp or email. They conducted 2 meeting no MOM was shared nothing. As per byelaw 11 members committee is to be formed (6 open, 2 women, 1SC/ST,1NT,1OBC). Initially 8 members applied for open category. For women they fixed seats and did not let others apply for it. I am from ST category yesterday came to know 1 more candidate applied for SC. 2people applied for OBC but they asked 1 to withdraw. Previous committee members advised both of us that as you are from caste category you can't contest for women seat.
We want to know Is this the correct way of holding election?
Can reserved category candidate apply through open / women category?
We have not filled any forms yet as they said we will fill forms only for those who will be in committee to avoid expenses. They are thinking to conduct internal elections. As no forms have been submitted can we change nomination category?
Please guide us
Reserved category can apply n open seats. There is no bar regarding contesting elections in this manner. However, for women category, determination of gender holds significant. A male cannot apply under this category, no matter what the circumstances may be. You would have to check with the internal rules of the particular cooperative society, where nomination category can be changed.
