Hello,

I had signed a lease deed in July 22 and as per the lease deed terms it is mentioned :

1. At the end of the lease term, the lessee and lessor can renew the lease agreement for a further period of 11 months with a minimum of 5% escalation and a maximum of 10% escalation in the rent based on the mutual agreement at the end of the lease term.

2. Either of the parties can terminate the notice by giving 2 months written notice to the other.

For clause 1 and 2 above my lease is getting expired on 31 May 23 and said he is not interested in renewal, and asking me to enter a fresh lease deed with almost 40% increase. Is this not contradicting the clause.

Further, on 8th April he served the notice to me and asked me to vacate the premises by 31st May or agree on new lease terms which is approx 40% increase in rent. Then I told him i will vacate the premises by 15th May 23 and now asking me to pay rent till 31st May even if I am not staying in the flat for 15 days.

How this can be handled and is this legally fine from owner’s side.

A.Dear Client,
Since, the clause mention 5-10% person increase, then it is illegal to ask for a 40% increment. You can take legal action in this regard. However, if the clause mention the last date as 31st May, you will have to pay the amount till that date, irrespective of your presence there or not.
