Is it legal to pay Recovery Amount of FNF for getting back my Original Document Is it legal to pay Recovery Amount of FNF for getting back my Original Document

I joined this company as a fresher this was my 1st job with toxic environment and the management was so bias towards gender, color, caste and everything possible. At first they took my Original Document of 12th Marksheet for HR Purposes but didn't give back as it was their policy to keep the documents. Now after 11 months when I resigned I had to serve 3 months Notice period which was not possible for me to serve. I served only 25 days of Notice Period and Hand overed all my responsibilities. I don't want Relieving or Experience Letter from their side I just asked them for my Original Document to give me back my Original Document of 12th Marksheet but they are telling me to pay my FNF amount. Is this legal to pay??

A.Dear Client

The legality of withholding your original document and demanding payment of FNF depends on the terms of your employment contract and applicable laws. Employers may not withhold original documents without a valid reason. However, if there are outstanding dues or obligations owed to the company, they may have a right to withhold documents or demand payment. You should review your employment contract and company policies to determine the legality of the demand. Please seek an expert legal advice over this matter.
