Sale agreement of Agrl Land - 10 yrs elapsed
1 year ago
my question is the agreeent of sale is barred by limitation or not. the agreement of sale with 10 years over, can be enforced against Seller.that too not registered sale agreement, no time limit is mentioned in the sale agreeent, now the prospective purchaser issued legal notice to give and the party pays the agreed amount .But there is change in maket price of land at present.
As there is no time limit is mention so limitation starts from the date of your refusal . Since it is unregistered he has to pay penalty to legalize such document. Any way you can claim more price .
A.Dear Client,
A registered sale agreement is deemed to be valid for three years. In the presence of a negative clause in the agreement, for instance, in case the buyer is required to register a property within three months, the limitation is then extended by such a period.
No, a non registered sale agreement although, no time limit has been mentioned on it, cannot be enforced against the seller.
