My question is - what are the documents necessary for the wife to become karta when the the husband is deceased and the two children are minor in a HUF account in a national bank kotak . Need a list of documents required . Here there is no will involved as the death is sudden and the widow is listed as coparcener .

A.Dear Client

In case of the demise of the Karta of HUF, the next senior-most member of the family becomes the new Karta. If there are multiple sons in the family, the eldest son becomes the Karta. The Karta has the power to distribute the assets of the HUF among the members of the family according to their rights and shares. You need to obtain a surviving Legal Heirs Certificate from the concerned Civic Authority or CO of the area and submit the same to the Bank to records of Bank in the name of Wife who is the Senior most member of the family. However, Bank may ask for other documents if required.
