6 months Notice Period or pay 6 months salary
10 months ago
I am a teacher working at a prime IB School in Mumbai for hte last 3 years. They have made us sign contracts which states we need to provide 6months notice period only before Dec1 to be relieved by June1. Any other time then we can only be relieved by paying 6 moths of our salary back to the school. I have to resign due to unavoidbale circumstances and I can maximum serve a notice period of 3 months. They are harrassing me into legal issues and planning to send people home to extort money just because they coerced me into signing the contract during joining. They have not spent a money in my development as an employee infact have made me work double positions for no extra salary. The only reason I want to leave amicably is I have had a good time teaching the kindergarten children there and the colleagues have been extremely supportive thorughout.
As per the information you have given it is suggested to you that you need not to worry about this , instead you can file a FIR against them for harassment .
And in regard to the notice period if dont fufill the notice period you cannot have your experience letter from there without serving notice period.
From the contents of your query, it appears that the conditions of your contract of employment are highly arbitrary, unethical, and unlawful too. Taking the advantage of employment crisis some employers adopted the unfair trade practice. So, in the given situation, in case you feel any threat of safety and security, you may lodge a complaint in the local police station against the School Authority for harassment and coercive action. Make an application to the District School Inspector, concerned explaining therein the unethical activities and coercive action of the School Authority forcing the teachers to agree with their arbitrary and illegal conditions. Next, you can approach the Civic Authorities who issue license or Certificate of Enlistment to all establishments including a school that renders educational service from KG to PG. And non-payment of your legitimate dues you may approach the concerned office of the Labour Commissioner for desired reliefs.
