I have resigned from company but they are not relieving me ... Saying that i have to serve notice period of 2 month. I am ready to pay for notice period but they are not agreed to that . I have a Joining date within 1 month in other company . What should i do ??

A.Dear Client,

You are duty-bound to comply with the condition of your contract of employment i.e, offer letter that requires service 2 months' notice before tendering resignation from the Company. Now in case of deficiency on your part and also in the absence of any buy-out policy, Company may deny the issue of relieving letter to you. So, considering your career prospect you may request your Company to negotiate and resolve the matter. In case you go for litigation it may takes lot of time that may affect your new prospect. However, in case your approach fails, you may approach the Labour Commissioner concerned for his kind intervention in to the matter stating your career prospect for a resolution in the matter.
