I've signed a service agreement for 3 years in an organization violating which I need to pay 5,00,000(5 lakhs INR). I've already served 25 months, My job role is not the same as communicated during recruitment and does not match my career expectations. And Company does not have any projects. Instead of giving me increment, they added me in pip plan. And made me very negative. Before this I have worked on 3 projects in 1 year.

A.Dear Client,

In the given situation, you need to go through each term and condition of your contractual agreement carefully. In the absence of a flexible exit policy even in case of fixed-term employment explaining the unavoidable situations if arises in the course of fixed-term employment and are beyond the control of either party, the agreement of contractual employment may be termed as biased being arbitrary and contrary to the principle of natural justice and may be canceled/scrapped on contest before the appropriate authority or Court. Moreover, You have already completed a lions part of your fixed term employment and now when the company instead of paying an increment, added you to their pip plan in breach of or violation of the terms of the employment by themselves, you may tender your resignation without refund of any part of bond especially when the present situation or negative working environment does not suit your credentials or terms of employment. Let the Company take action against you based on the biased agreement contract of employment and breach of condition of said agreement on their part. Until and unless a cause of action is raised from either side, no appropriate steps to face that action/situation can be suggested as of now. You may revert back to us in any such situation or cause of action arises.

A.Dear client,

You can pursue legal action against your employer and sue for damages since there is a clear violation committed by the employer.
