Can we file a case if some is not returning the amount of 3k?

It is a very small amount and it being a transaction in civil nature as such you cannot go to Police Station. However, on sympathy grounds Police may help you to get such amount recovered or get postdated cheque in your favour.

A.A lot of your query is unclear, as in why was the amount supposed to be returned? etc
If there was some contract that stipulated that the 3k had to be returned , then it can be legally enforceable.
