Hii..
I was working in a place as a part timer and i left that job and worked for 2 months i informed them before leaving and this incident happened in 2022 when I was a final year student after completing my graduation asusual i applied for companies and got selected but my application got rejected because I already have an pf account.. i searched a lot and later i got to know that when I was working as a part timer they have created my pf account after some months i requested them to provide me a relieving letter and i told them that no one has informed me tht i should server the notice period even the store manager dint tell me anything about notice period. So HR team replied me that there is a recovery of Rs 3,309 /-
And i replied them that am ready to pay the amount please give me relieving letter I'll pay the amount of notice period
And am requesting them to guide me to pay the amount but it's been more than 10 days i dint get any update from them they are playing to provide me relieving letter . Am really fed up i can't get placed in good company if they dint give me relieving letter please help me out am sooo worried about my future what action i can take to get my relieving letter

A.Dear client,

Whatever be your nature of employment, part, full or contractual, you were issued an offer letter by your employer that governs the relationship between you and your employer. So go through the terms and conditions of said offer letter on acceptance of which you resumed the company. If the terms of said offer letter contain the stipulation that before tendering resignation from the Company you to serve a notice period for certain that varies from 15 to 90 days in different organizations, you are dutybound to comply with the said condition of the offer letter. However, in case there is no stipulation in the offer letter as such, then the Company can not force you for the same and even cannot claim or recover any amount for non-compliance of said condition of resignation especially when you left the Company with information in 2022. Had there any condition as such they should have informed the same at the relevant time. Now on your appeal seeking the issue of relieving letter, they raised the point to harass you which may be termed as unfair labour practice on the part of an employer if the matter is litigated. So, if the delay in resolving the matter appears to be too much affecting your career, then reach out to the office of the concerned Labour Commissioner to file a complaint on the subject against the Company for redressal of your grievance. They haven't mentioned anything in offer letter ..
Notice period is of 15 days but I told them that I'll pay the notice period amount insted of serving the notice period..
But they agreed and they said me to pay Rs 3,309/-, later i requested them to guide me to pay the amount because I can contact HR only threw mail that's all..
But it's been more than 10 days they are not saying anything they are telling me where to pay and they re even updating me about relieving letter

You are already suggested that if the delay in resolving your grievance appears to be too much or indefinite affecting your career, you should reach out to the office of Labour Commissioner and file a complaint against the employer for victimization and unfair labour practice.
